As anyone who has been charged with completing employment eligibility verification can attest, it can be an arduous, labor-intensive, sometimes-tricky process. The Legal Workforce Act, which was introduced last Congress in the U.S. House of Representatives by Rep. Lamar Smith (R-TX), is designed to streamline and modernize the process.

Specifically, the law would mandate e-verify, reduce the number of acceptable documents used for verification, provide protection from liability for employers who comply with the law in good faith, and preempt state and local laws and ordinances that impose additional employment verification requirements on employers.

On February 4, CUPA-HR had the opportunity to testify in support of the Legal Workforce Act before the House Subcommittee on Immigration and Border Security. Jill Blitstein, international employment manager at North Carolina State University, testified on behalf of CUPA-HR. In her testimony, Blitstein shared her experiences with e-verify and CUPA-HR’s support for the bill.

She also offered several suggestions CUPA-HR has for improving the Legal Workforce Act, which are intended to make it easier for colleges and universities to complete the verification process and maintain compliance.

Our recommendations included:

  • Implementation of a 24-month, phased roll-out compliance timeframe for re-verification of public-sector employees (as opposed to the six-month timeframe currently mandated by the Act).
  • Extending the timeframe for verifying foreign national employees who have applied for a social security number (the Act currently proposes that verification be completed within three days after receipt of the social security number).
  • Implementation of a 30-day re-verification period for those employees with limited work authorization (the Act in its current form would require re-verification of such employees — including many foreign nationals — within three business days after the expiration of their current work authorization).
  • Extending the verification period to at least five business days after the hire date (currently verification must be completed within three business days after the hire date).
